Case description
The HACC confiscated more than UAH 1.25 million from former MP Illia Kyva. The case refers to the so-called pulp pits, which Bihus.info journalists covered back in 2020.
A pulp pit is a part of a land plot that was once used by a sugar plant to dump waste from sugar weed processing. Kyva allegedly leased it to Company Sequel LLC, for which he must have received money. However, at the time of the lease, the plot had already overgrown with weeds and had not been used for a long time.
The company that allegedly rented this land is located in Lviv, but the object of the lease is in the Poltava region. Along with the land plot, Company Sequel LLC also used a garage with an area of over 390 square meters.

Prosecutors argued that Kyva did not own the pit and the garage at the time of the lease, and therefore had no right to lease it. That is why the funds received are unfounded assets and are subject to confiscation.
In addition, the company that rented the land plot did not have the necessary material and technical resources to use the pit. Even according to the data of the tax authorities, the company was not listed as a lessee of this land. Therefore, there is every reason to claim that such an agreement is fictitious.
Kyva himself explained in an interview to journalists that his lawyers dealt with the leasing of the land plot, so he could not speak about the details of the agreement.
However, the court decided to confiscate the money Kyva received, and this was the first time that the HACC issued a decision on the confiscation of unfounded assets.
