Case description

On November 22, 2022, the HACC delivered a verdict against five people involved in a corruption scheme at the Elektrovazhmash plant: as a result of fraudulent sales of spare parts to a Lithuanian company, the plant lost UAH 13.7 million. Mykola Korniichuk, former deputy director of the plant, was sentenced to 4 years in prison, three of his accomplices were also sentenced, and one defendant was acquitted.

In 2017, Electrovazhmash refused to sell spare parts to the Lithuanian company directly, instead arranging the scheme through another company. Parts for the repair of the Kruonis hydroelectric power plant in Lithuania were initially sold to a Czech company for EUR 600,000, and a Lithuanian company bought them for twice the price of EUR 1.22 million. As a result, Elektrovazhmash did not receive UAH 13.7 million, which was confirmed by examinations.

The scheme involved Mykola Korniichuk and Oleksandr Hordii, former deputy directors of Elektrovazhmash; Oleh Bohdanov, the plant's head of management, as well as Andrii Yevdokymov and Oksana Yevdokymova, the ultimate beneficiary and directors of the Czech company. Korniichuk was the executor in the case, and all the others were accomplices.

This investigation was the third in a series of investigations into the abuses at Elektrovazhmash.

Korniichuk's actions were classified under Article 364, part 2 of the Criminal Code of Ukraine, and three other defendants were classified under Article 27, part 5, and Article 364, part 2 of the Criminal Code of Ukraine

Korniichuk and Bohdanov, former plant officials, were sentenced to 4 years in prison with a fine of UAH 17,000 and a ban on holding certain positions for 3 and 2.5 years, respectively. Oksana Yevdokymova was sentenced to 3.5 years in prison, a UAH 17,000 fine, and a 3-year ban on holding certain positions. Andrii Yevdokymov was imprisoned for 4 years with a similar fine of UAH 17,000. 

At the same time, the HACC acquitted Oleksandr Hordii, one of the former deputy directors of the plant, who was charged with Article 27, parts 2, 3, 5; Article 364, part 2 of the Criminal Code of Ukraine.

The judges also applied special forfeiture of EUR 217,000.

In 2017, former Elektrovazhmash officials sold spare parts to a Czech company at a reduced price, which were later resold to a Lithuanian company at twice the price. As a result of these frauds, the state-owned enterprise lost UAH 13.7 million.
