Case description
In December 2017, Oleh Yushchuk, upon learning that the DUI case would be heard in his court, offered the defendant to pay a USD 500 bribe to influence Yushchuk's colleague and stall the trial. In March of the following year, Yushchuk informed the defendant that the money should be transferred through a lawyer. Yushchuk was detained when he received the marked bills.
The court classified Yushchuk's actions under Article 369-2, part 2 of the Criminal Code of Ukraine and sentenced him to 3 years of imprisonment.
Oleh Yushchuk's defense counsel tried to appeal the court's decision, referring to violations during covert investigative actions and searches and also emphasizing the fact of a provocation. The HACC Appeals Chamber partially upheld the appeal in terms of invalidating one of the protocols, but the verdict itself remained unchanged.
