Case description
The HACC sentenced Vitalii Borodin, former acting head of Mykolaivoblteploenergo (regional heating and electricity distribution company), to 8 years in prison for concluding unfavorable contracts with losses of UAH 2.74 million.
In 2015, Vitalii Borodin was the chief engineer of Mykolaivoblteploenergo. In November of the same year, he concluded 138 subcontracts for the installation of meters with the company Ukrenergoservice. In fact, the contractors did not perform these works, and Borodin drew up fictitious service acceptance certificates with an inflated cost of each installed meter and submitted them for signature to the director of the company, who did not know about his criminal intent.
11 subcontracts were not included in the investment program at all, and later Borodin received part of the transferred funds back through a controlled company. The state suffered more than UAH 1.75 million in losses.
Borodin was convicted under Art. 191, part 5, Art. 366, part 1 of the Criminal Code of Ukraine. The HACC sentenced the ex-official to 8 years of imprisonment with confiscation of all property and a ban on holding certain positions for 3 years. The defense counsel of the accused filed an appeal.
